Wills
Estate Planning Made Simple
Drafting a will allows you to distribute assets according to your wishes.
01
Special inheritance regulations apply depending on whether the testator is Muslim or non-Muslim.
02
There is no residency requirement for creating a will in the UAE.
03
Remote notarization of wills is available, removing the necessity of being physically present in the UAE.
Inheritance Without a Will for Non-Muslims
In cases where there is no will, asset distribution typically follows these guidelines
Rule i
If the deceased had a spouse and children – 50% of the estate goes to the spouse, with the remainder equally divided among the children of the testator.
Rule ii
If the deceased had no children – assets are divided equally between the surviving parents. If one parent is deceased, the remaining portion is distributed among siblings (if any).
Rule iii
If the deceased had a spouse but no children – 50% is inherited by the spouse, while the other half is allocated among the surviving parents or siblings.
rule iv
If none of the above heirs exist – the estate is passed on to the testator’s siblings.
Inheritance with a Will for Non-Muslims
A valid will provides control over:
Selecting applicable law
If the testator holds multiple nationalities, the law applicable will be the one specified in the wil
Appointing guardians for children
Without a will, courts decide guardianship following UAE laws, which may place custody with local authorities
Keeping bank accounts active
If an individual passes away without a will, all personal and joint bank accounts are frozen
Wills can be prepared by UAE residents and non-residents at the Dubai International Financial Centre (DIFC) or with an Emirati notary.
Both options permit remote procedures with witnesses. Drafts in English are accepted, while notary wills require an Arabic translation.
With an Emirati Notary
01
More cost-effective than DIFC registration
02
Remote notarization through a video conference is permitted without the need for witnesses
03
Drafts in English require an Arabic translation
With the DIFC Wills and Probate Registry

May be drafted exclusively in English
02
Remote procedure (via video conference) is possible with two witnesses present
